By participating in the FrostMist Affiliate Program, you agree to these Affiliate Program Terms and Conditions and to the general FrostMist Terms and Conditions available on this website.
1. Affiliate Relationship
Approved affiliates may promote FrostMist products using referral links provided through their affiliate account.
Affiliates act as independent parties and are not employees, agents, representatives, or partners of FrostMist. Participation in the program does not create any employment, agency, partnership, joint venture, or similar relationship.
2. Commissions
Unless otherwise agreed in writing, affiliates earn a 25% commission on eligible purchases attributed to their affiliate account.
Commissions are calculated on the product purchase amount after discounts and excluding applicable taxes.
Referral attribution is subject to the tracking rules and attribution period is described on the Affiliate Program page.
3. Refunds, Cancellations, and Invalid Transactions
No commission is payable on refunded, cancelled, fraudulent, chargeback, or otherwise invalid transactions.
FrostMist may reject commissions associated with such transactions.
Self-referrals or purchases made primarily for the purpose of earning affiliate commissions are not permitted.
4. Payments
Approved commissions are paid periodically using a payment method agreed between FrostMist and the affiliate.
FrostMist may delay payment while a transaction is being reviewed or while a payment dispute, refund, or chargeback remains unresolved.
Affiliates are responsible for any taxes or reporting obligations arising from affiliate payments they receive.
5. Promotion and Disclosures
Affiliates must clearly disclose that they may receive a commission from purchases made through their referral links.
Promotional statements must be truthful and must not be misleading. Affiliates must not make guarantees or unsupported claims regarding profitability, investment returns, trading performance, or expected results.
Any reviews, testimonials, or statements about FrostMist products must reflect the affiliate’s genuine experience and opinions.
Affiliates must not state or imply that FrostMist, NinjaTrader, any broker, exchange, or other third party guarantees or endorses trading results.
Affiliates are responsible for ensuring that their promotional activities comply with all applicable advertising, privacy, anti-spam, and electronic marketing laws and regulations, including applicable consent, sender-identification, and unsubscribe requirements.
6. Prohibited Promotion
Affiliates may not use spam, unsolicited electronic messages, cookie stuffing, misleading advertising, fraudulent or incentivized traffic, or other deceptive promotional methods.
Affiliates may not bid on FrostMist, FrostMist product names, or confusingly similar terms in paid search advertising without prior written permission.
Affiliates may not use sub-affiliates, affiliate networks, or other third parties to distribute FrostMist referral links without prior written permission from FrostMist.
7. FrostMist Intellectual Property
Affiliates may use logos, product images, descriptions, and other promotional materials provided or expressly approved by FrostMist solely for the purpose of promoting FrostMist products.
Affiliates may not modify FrostMist branding in a misleading manner or represent themselves as FrostMist or as an official FrostMist representative.
8. Program Changes and Termination
FrostMist may modify commission rates, attribution rules, payment terms, or other aspects of the Affiliate Program upon reasonable notice.
Commission-rate changes do not affect commissions already generated before the effective date of the change.
Either FrostMist or the affiliate may terminate participation in the program at any time.
FrostMist may immediately suspend or terminate an affiliate account for fraud, misleading promotion, undisclosed affiliate relationships, abuse of the referral system, or other material violations of these terms.
Valid commissions earned before termination remain payable unless they resulted from activity prohibited by these terms.
9. Governing Terms
The FrostMist Terms and Conditions, Privacy Policy, trading-risk disclosures, limitations of liability, and governing-law provisions available on frostmist.com also apply to participation in the Affiliate Program.
In the event of a conflict specifically concerning affiliate participation, these Affiliate Program Terms and Conditions will govern.
